Instructor Terms and Conditions

DESCRIPTION OF SERVICES:

PR School of Real Estate, from here-in called “Provider”, will provide to the Instructor the following:

1. An Independent Contractor Agreement
2. Certified classes to instruct
3. Maintain records of classes
4. Issue the Certificates to students
5. A 1099 at the end of each calendar year

The Instructor will provide the following for the Provider:

1. Application for Instructor
2. Copy of Instructor’s Certification
3. Copy of Driver’s License
4. Proof of insurance. (Car not less than 100/300)
5. Proof of membership in the REALTOR Association.
6. Provide the following within 5 business days of each class at the school address:
a) Enrollment Forms
b) Sign in Sheet
c) Evaluation Sheets
d) Any monies collected for late enrollment

PERFORMANCE OF SERVICES:

The manner in which the services are to be performed and the specific hours to be worked by Instructor shall be determined by the Instructors agreement with the company for which the Instructor has contracted. It will be the responsibility of the Instructor for all classes booked and fees associated with the class to be reported and delivered to the school. It is the sole responsibility of the Instructor to fulfill any contractual obligations concerning scheduled classes.

The Provider will be provided 1 copy of the materials for each class, which Instructor instructs. Any additional materials needed are the sole responsibility of the Instructor.

PAYMENT:

The Instructor will be paid according to the Instructor’s Independent Contract Agreement for his or her services. The following items will be deducted from the amount received as payment for the class:

1. Business and Occupation tax: (1.5%)
2. Cost of Certificates ($10.00 per Certificate)
3. Cost of use of Provider’s materials (See Schedule of Costs)

All Instructor checks will be issued within 5 business days of completion of class and all monies have been received for the class.

EXPENSE REIMBURSEMENT:

The Provider will not reimburse Instructor for “out of pocket expenses”, however if travel expenses or material expenses are paid for by Instructor and are within the funds received from the client contracted with, then the expenses will be passed through to the Instructor.

SUPPORT SERVICES:

The Provider will provide the following support services for the benefit of the Instructor:

1. Accredited Classes from the State of Washington.
2. Forms as required for by the Provider for documentation of classes, evaluation of class, and student attendance.
3. Continued development of additional classes to instruct.
4. Fee schedule for use of Provider Owned Classes

NEW PROJECT APPROVAL:

Instructor and the Provider recognize that the Instructor’s Services will include working on various additional classes for which Instructor shall obtain the approval from Washington State Department of Licensing Real Estate Division through the Provider prior to the instruction of any new classes.

TERM/TERMINATION:

This agreement shall apply to Instructor and Associates and shall run with each signed Provider/ Instructor Agreement (Independent Contractor Agreement).

RELATIONSHIP OF PARTIES:

It is understood by the parties that Instructor is an Independent Contractor with respect to the Provider, and not an employee of the Provider. The Provider will not provide fringe benefits, including health insurance benefits, paid vacation or any other employee benefits, for the benefit of Instructor.

INTELLECTUAL PROPERTY:

The following provisions shall apply with respect to copyrightable works, idea, discoveries, inventions, applications for patents, and patents (collectively, “Intellectual Property”):

1. Instructor’s Intellectual Property.
a) Instructor Personally holds an interest in the Intellectual Property

2. Development of Intellectual Property
a) Any improvements to Intellectual Property (Courses), further inventions or improvements, and any new items of Intellectual Property discovered or developed by Instructor (or Instructor’s Associates, if any) during the term of his or her Independent Contract Agreement shall be the property of the Instructor. Each party shall execute such documents as may be necessary to prefect and preserve the right of either party with respect to any such Intellectual Property.

NOTICES:

All notices required or permitted under the Independent Contractor Agreement or the Enrollment Form shall be in writing and shall be deemed delivered when delivered in person or deposited in the United States mail, postage prepaid, addressed as follows:
